Yellow Marigold is a brand name used by Butterfry Hospitality LLP, incorporated pursuant to Section 12(1) of the Limited Liability Partnership Act, 2008, having its registered office at Flat No. 34, Curzon Road, Doon International School, Dehradun, Uttarakhand – 248001 ("we", "us", "our").

By accessing or using the website www.yellowmarigold.in (the "Site"), or placing an order through it, you ("you", "your", "Buyer", "Customer") agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not use the Site or place an order.

1. Supply of Goods & Orders

1.1 We operate the Site to sell handmade and artisanal lifestyle products ("Products") to consumers.

1.2 All orders are subject to availability and our acceptance. We reserve the right to refuse or cancel any order at our discretion (including where payment fails, product is unavailable, or we are unable to fulfil for any reason).

1.3 Product descriptions, images and specifications are provided in good faith. Due to the handmade nature of our Products, slight variations in colour, size, finish or pattern are normal and do not amount to defects.

2. Pricing & Payment

2.1 All prices are in Indian Rupees (INR), inclusive of applicable taxes unless stated otherwise. We reserve the right to update or change prices at any time before order acceptance.

2.2 Accepted payment methods are prepaid cards, net banking, UPI, and Cash on Delivery (COD) where available.

2.3 For prepaid orders, payment must be cleared before dispatch. For COD orders, applicable processing or shipping fees will apply as per our Shipping & Payment Policy.

2.4 We reserve the right to cancel any order in the event of payment issues (unauthorised, fraudulent or otherwise invalid).

3. Shipping, Delivery & Risk

3.1 Please refer to our Shipping & Payment Policy for complete details on dispatch, delivery timelines, shipping charges, COD fees and related terms.

3.2 Risk of loss and title to the Products pass to you at the time the Product is delivered (or attempted to be delivered) to the nominated address.

3.3 If a package appears damaged, tampered with or incorrect upon delivery, you must notify us within 48 hours of delivery as specified in our Shipping & Payment Policy.

4. Returns, Exchanges & Refunds

4.1 Returns, exchanges and refunds are governed by our separate Returns & Exchange Policy.

4.2 The policy includes conditions, timeframes, eligibility (including defects or damage), and non-returnable items such as sale products or those with slight artisanal variations. Please review the policy carefully.

5. Intellectual Property

5.1 All content on the Site, including text, images, graphics, logos, trademarks, product designs and source code, is owned by or licensed to Butterfry Hospitality LLP and protected under applicable intellectual property laws.

5.2 You may view, print or download material from the Site for personal, non-commercial use only.

5.3 You must not reproduce, modify, distribute, display or commercially exploit any part of the Site or its content without our prior written consent.

6. Acceptable Use

6.1 You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the Site.

6.2 Prohibited activities include:

• Attempting to interfere with or hack the Site's security or functionality.

8.1 The Site and all Products are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all express or implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

8.2 We shall not be liable for any indirect, incidental, special or consequential loss, including lost profits, data loss or business interruption, arising out of or in connection with your use of the Site or Products, even if advised of the possibility of such loss.

8.3 Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence or any other liability that cannot legally be excluded.

9. Sale & Promotional Pricing Conditions

9.1 In the event of a sale or promotional pricing event:

• The offer will apply only to selected products and only during the promotional period.
• Unless otherwise stated, items on sale may be non-returnable or non-exchangeable except in the event of a manufacturing defect or an incorrect/damaged item being shipped.
• We reserve the right to cancel orders if stock is unavailable or quality standards are not met.
• In cases of pricing discrepancies (error in discount or listing), the price shown at checkout shall be deemed final.

9.2 Gift wrapping, special services or customisations may not be available during high-volume sale periods.

9.3 International duties, taxes, shipping charges and currency conversion fees, where applicable, shall be borne by the Buyer.

10. Governing Law & Dispute Resolution

10.1 These Terms shall be governed by and construed in accordance with the laws of India.

10.2 The courts of Dehradun, Uttarakhand shall have exclusive jurisdiction to resolve any disputes arising under or in connection with these Terms.

10.3 If any provision of these Terms is found to be invalid, unenforceable or illegal, that provision shall be deemed omitted to the extent of such invalidity, and the remaining provisions shall continue in full force and effect.

11. Modifications to Terms

We reserve the right to update, amend or modify these Terms from time to time without prior notice. We will post the revised Terms on the Site with an updated Effective Date. Your continued use of the Site after such changes constitutes acceptance of the revised Terms.

12. Notices & Communications

When you use our Site, place orders or contact us via email, you agree to receive electronic communications, including emails and notifications on the Site. These communications satisfy any legal requirement that they be in writing.
